Barack Obama "Hope" poster case is another case study that very interesting which designed by an artist named Shepard Fairey. Shepard Fairey taking the photos of Mannie Garcia, photographer of AP News Agency without permission and sold to the big money. This poster was widely described as an iconic, together with this picture also using in the 2008 presidential campaign. Shepard edit the photo with stylized stencil portrait in red, light brown and blue, including put the word Hope in it. Later, The Associated Press has reveal that fairey poster based on their's work, however Fairey sued for declaratory judgement by saying his poster was a fair use. Nevertheless, the AP claimed that Fairey work is not fairuse, but it is duplicate. Finally, Fairey was sentenced to two years of probation, 300 hours of community service, and a fine of $25,000.
